Terms of Service

Last updated: June 8, 2026

These Terms of Service ("Terms") govern your use of the KickPay mobile application and related services (collectively, the "Service"). By using KickPay, you agree to these Terms. If you do not agree, do not use the Service.

1. About KickPay

KickPay is a payroll-connected earned wage access service. We advance a portion of your earned-but-not-yet-paid wages to your bank account, and collect repayment (plus a flat fee) via ACH debit on your confirmed pay date.

KickPay is not a loan. It is not a credit product. It does not involve interest or APR in the traditional sense.

2. Eligibility

To use KickPay, you must:

Eligibility is based on verified employment through your payroll provider — not your credit score. We do not perform credit checks.

3. Cash Advance Terms

Advance Amount
$75

Maximum advance per pay period. Actual availability depends on your payroll data.

Flat Fee
$3.99

One-time fee per advance. No interest, no hidden costs, no recurring charges.

APR Equivalent (Disclosed)
~139%

For illustrative purposes only. Example: $75 advance with $3.99 fee, repaid in 14 days = ~139% APR equivalent. This is not interest — it is a flat fee for a single advance.

Repayment. By requesting an advance, you authorize KickPay to debit your bank account for the total repayment amount ($75 + $3.99 = $78.99) on your confirmed pay date. The debit date is shown to you before you authorize the advance.

Revocation. You may revoke this ACH authorization by providing written notice to support@kickpay.xyz at least 3 business days before the scheduled debit date.

4. What KickPay Is NOT

KickPay is not:

The flat fee is not interest. KickPay does not charge interest on advances.

5. ACH Debit Authorization

By tapping "I agree" on the advance authorization screen, you:

6. Limitation of Liability

KickPay's liability is limited to the amount of the advance fee paid. We are not responsible for delays in fund delivery caused by your bank or payroll provider. We are not responsible for ACH return fees charged by your bank.

7. Account Suspension

We may suspend your access to KickPay if you have a delinquent advance (ACH return or failed repayment). We may also restrict future advances if repayments are returned.

8. Privacy

Your use of KickPay is also governed by our Privacy Policy. We access payroll data through Argyle for eligibility purposes only. We do not sell your personal information.

9. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via the app. Your continued use of KickPay after changes are posted constitutes acceptance of the updated Terms.
