KickPay ("we," "us," or "our") operates the KickPay mobile application and website (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service.

Payroll Data. With your permission, we access employment and income information through Argyle, a payroll connectivity provider. This includes employment status, pay frequency, and estimated gross pay. We do not access full payroll records, bank account numbers, or Social Security numbers.

Device Information. We may collect device type, operating system version, and app usage data to improve the Service.

Usage Data. We collect information about how you interact with the Service, including which features you use and when.

2. How We Use Your Information

We use the information we collect to:

• Determine your eligibility for a cash advance
• Process and service your advance requests
• Schedule and collect repayments via ACH debit
• Communicate with you about your account
• Detect and prevent fraud
• Improve our products and services

3. Data Sharing

We do not sell your personal information. We may share your information with:

• Argyle — for payroll connectivity (read-only access to your employment data)
• Banking partners — to process ACH debits for repayment
• Service providers — who assist with payment processing, data storage, and analytics, under strict confidentiality obligations
• Legal authorities — when required by law or to protect our legal rights

4. Data Retention

We retain your data for 90 days after your repayment is confirmed. If your account is inactive for more than 90 days, we will delete or anonymize your data unless we are required to retain it for legal compliance purposes.

5. Security

We use industry-standard encryption (TLS) to protect your data in transit. Payroll data accessed via Argyle is stored securely and never shared with third parties for marketing or advertising purposes.

6. Your Rights

Depending on your state of residence, you may have the right to:

• Request access to the personal information we hold about you
• Request correction of inaccurate information
• Request deletion of your personal information
• Opt out of certain data sharing (where applicable)
